# Terms and Conditions of Use (TCU) These Terms and Conditions of Use (TCU) define and govern the use of our website (hereinafter referred to as "the Site"). They provide information on the rights and obligations of visitors (hereinafter referred to as "Users") and the Site's publisher (hereinafter referred to as "the Publisher"). By accessing and using the Site, you unreservedly accept these TCU. ## 1. Acceptance of Terms By browsing the Site, you acknowledge that you have read and accepted these TCU. This acceptance creates a contract between you and the Publisher, defining your rights and obligations concerning the use of the Site. ## 2. Rights and Obligations of Users ### 2.1 Browsing and Using the Site Users may freely browse the Site and use its features in accordance with these TCU. Users agree to: - Use the Site legally and in compliance with the laws in force. - Not publish duplicated content or content protected by copyright without authorization. - Not make defamatory, insulting, or false statements on the Site, forum, or chat. - Not send a photograph to which they do not hold the necessary rights. - Not send a photograph showing an identifiable person without their consent, nor any unlawful, violent, hateful or pornographic content. ### 2.2 User Account For certain features, Users may need to create an account by providing an email address and a password. Users are responsible for the confidentiality of their login information and all activities conducted under their account. ### 2.3 Photographs attached to a question Users with an account whose email address has been confirmed may attach one or more photographs to their question, in order to illustrate a game situation. By attaching a photograph, the User declares and warrants: - that they hold all the necessary rights to that image, or that they have obtained the authorization of the rights holders; - that it shows no identifiable person without their consent, and contains no unlawful, violent, hateful or pornographic content; - that they grant the Publisher, free of charge and non-exclusively, for as long as the question and its answer are kept, the right to reproduce that image, to resize it, to transmit it to the artificial intelligence providers used by the Site to produce the answer, and to display it to them on the corresponding answer page. Photographs attached to a question are visible only to their author. They are not shown to other Users, including when the link to the answer page is shared: the person given that link sees the question and the answer, and only a mention of the number of photographs accompanying them. A User may ask the Publisher for the photographs of their own questions to be made visible to everyone; this listing is done case by case, it is reversible at any time on simple request to contact@ludo.help, and it applies both for the future and to the questions already asked by that account. Each photograph is converted on arrival into a reduced resolution suited to its transmission to an artificial intelligence model, and its metadata — in particular the date, the device model and the geographic position — is removed on that occasion. Photographs are not indexed by search engines; they are only reachable through addresses specific to the Site, and each viewing checks that the requester is indeed their author. The Publisher reserves the right to refuse, not to transmit and to delete any photograph that an automated analysis, or a report, indicates to be in breach of the above. The User is then informed and invited to remove or replace the image before sending their question again; where the question had already been charged, it is refunded to them, up to three refunds a day and six a week. The User may at any time remove a photograph from their question before sending it, or ask for the deletion of a photograph already sent by writing to contact@ludo.help. Deleting their account entails the deletion of all their photographs. ## 3. Rights and Obligations of the Publisher ### 3.1 Responsibility The Publisher strives to provide continuous access to the Site but does not guarantee uninterrupted or error-free operation. In case of bugs or technical problems, the Publisher reserves the right to temporarily interrupt the Site's operation for maintenance purposes. Should the Site close for good, what becomes of the credits bought by Users is settled by article 9 of the Terms and Conditions of Sale. The Publisher disclaims all responsibility for: - Duplicated content or content protected by copyright published by a third party. The content will be removed upon request, providing proof of ownership of the rights to contact@ludo.help. - False statements, insults, or defamatory remarks made by Users on the Site. Such content will be removed upon request at contact@ludo.help. - Photographs attached to a question by a User, in particular where that User does not hold the necessary rights to them, or where they show an identifiable person without their consent. Such images will be removed upon request at contact@ludo.help. ### 3.2 Personal Data Protection The Publisher respects the confidentiality of Users' personal information and is committed to processing it in accordance with the provisions of the General Data Protection Regulation (GDPR). The personal data usage policy is detailed in our Privacy Policy. ### 3.3 Processing of photographs Photographs attached to questions are transmitted to third-party artificial intelligence providers for the sole purpose of producing the answer. They are used neither for advertising purposes, nor for the training of models by the Publisher, nor to answer other Users' questions. Where an answer can only be understood by looking at the photograph accompanying it, the corresponding question-and-answer pair is not reused to answer other questions. Photographs are kept for as long as the answer they relate to. ## 4. Changes to the TCU The Publisher reserves the right to modify these TCU at any time. The changes will take effect upon their publication on the Site. Users are encouraged to regularly review the TCU to stay informed of any changes. ## 5. Applicable Law and Jurisdiction These TCU are governed by the laws in force in the Publisher's country. In case of a dispute related to the use of the Site, the parties agree to seek an amicable solution before taking the matter to the competent courts. ## 6.
