# Terms and Conditions of Sale (TCS)

These Terms and Conditions of Sale (TCS) provide the necessary information to the customer before signing a contract for the sale of goods or services. They define the essential characteristics of the product sold, payment terms, sales conditions, legal guarantees, and the right of withdrawal.

## Attention

Do not confuse the TCS with the Terms and Conditions of Use (TCU). The TCU provides the rules for using a service (e.g., a website).

## 1. Essential Characteristics of the Product

The product sold consists of credits associated with the user's account. One credit is spent per question asked about the rules of a board game. Credits are sold in packs, in USD, at the rate of one credit for $0.05 — so a $2 pack is 40 credits, that is 40 questions. Packs run from 20 credits ($1) to 100 credits ($5), and an account holds at most 100 credits. Credits stay spendable for ten years, counted from the most recent arrival of credits on the account: a new purchase carries the rest of the balance forward with it.

## 2. Payment

Payments are made exclusively online via a form and in USD; prices are shown in credits everywhere else on the site, at the rate above. In case of a complaint, please contact contact@ludo.help. The payment credits the user's account as quickly as possible, ideally within seconds, but depending on the payment method, it may take several days. Payments are made to Pierre Scelles, the creator and administrator of the website, based in France, reachable at contact@ludo.help.

## 4. Recourse to a Consumer Mediator

In case of a dispute, you have the option to use a consumer mediator.

## 5. Applicable Law and Competent Court

These TCS are governed by French law. In case of a dispute, the competent court is located in Paris, France.

## 6. Warranties

- No financial guarantee and no professional liability insurance have been subscribed.
- No commercial warranty is offered: the only warranty on what is sold is the legal one described below.

The legal guarantee of conformity of articles L. 224-25-12 and following of the Consumer Code applies to the answers supplied. Where an answer is not delivered, or does not have the characteristics described in these Terms, the customer may obtain that it be brought into conformity and, failing that, a reduction of the price or the refund of the credit it cost. No stipulation of these Terms sets that guarantee aside, and any stipulation that appeared to would be void.

Answers are written by artificial intelligence models reading the rulebook of the game the question is about. They may be incomplete or mistaken, and they are not an authoritative reading of a game's rules: where an answer and the rulebook published by the game's publisher disagree, the rulebook is right. This says what is being sold; it does not limit the guarantee above.

The Site does not undertake to keep a past answer reachable for any particular length of time. Answers are in the public domain (article 7), the customer may download everything the Site holds about their account at any time from their profile, and the closing of the Site is governed by article 9 below.

## 7. Sales Conditions

Credits purchased by the customer to ask questions do not become the property of the customer. The generated answers enter the public domain under the CC0 1.0 license: [https://creativecommons.org/publicdomain/zero/1.0](https://creativecommons.org/publicdomain/zero/1.0).

Photographs attached by the customer to their questions are not covered by this placing in the public domain: they remain the property of their rights holders, are visible only to their author, and are used only under the conditions set out in article 2.3 of the Terms and Conditions of Use. Attaching a photograph to a question does not change its price.

## 8. Right of Withdrawal

If the customer wishes to withdraw from a credit purchase, they can contact the Site administrator via contact@ludo.help. The withdrawal period is 14 days from the validation of the online payment. This right of withdrawal only applies to amounts that have not yet been spent to obtain answers to questions about board game rules. When the Site is informed of the customer's decision to withdraw, it has 14 days to refund the full amount paid.

## 9. Closure of the Site

The Publisher is free to stop operating the Site at any time. A permanent closure is announced at least thirty days in advance, by email, to every account that still holds credits, and the sale of credits stops on the day of that announcement.

Credits left unspent on the day the Site closes are refunded at their purchase price, up to the sums the customer actually paid, without the customer having to ask for it, by crediting back the means of payment used for the purchase. Where that refund cannot be carried through — an expired card, a closed account — the customer is asked by email for another way of receiving it, and contact@ludo.help is read for at least twelve months after the closure so that it can be settled there.

Credits given free of charge cost nothing and are not refunded. Nothing in this article shortens the time the law allows the customer to claim the sums they are owed.
